सुप्रीम कोर्ट ने शुक्रवार को महिलाओं के लिए मासिक छुट्टी (Menstrual Leave) के मुद्दे पर अहम टिप्पणी की। कोर्ट ने एक PIL खारिज करते हुए कहा कि अगर मासिक छुट्टी को कानूनन अनिवार्य कर दिया जाए, तो इससे महिलाओं को नौकरी मिलने में मुश्किल हो सकती है और उनका करियर प्रभावित हो सकता है।

CJI सूर्यकांत और न्यायमूर्ति जॉयमलय बागची की खंडपीठ ने कहा, “कोई उन्हें जिम्मेदारियाँ नहीं देगा, यहाँ तक कि न्यायिक सेवाओं में भी सामान्य ट्रायल सौंपा नहीं जाएगा। अगर इसे कानून में अनिवार्य किया गया, तो महिलाओं के रोजगार पर नकारात्मक असर पड़ेगा।”
कोर्ट ने यह भी सवाल उठाया कि इस PIL को दायर करने वाला व्यक्ति स्वयं पीड़ित नहीं था और कोर्ट तक कोई महिला स्वयं नहीं आई। CJI ने कहा कि यह तरह की याचिकाएँ कभी-कभी युवा महिलाओं में यह धारणा पैदा कर सकती हैं कि वे किसी समय काम करने में पुरुषों के बराबर नहीं हैं।
सुप्रीम कोर्ट ने माना कि स्वेच्छा से दी गई मासिक छुट्टी बहुत अच्छी है। उदाहरण के तौर पर, कर्नाटक ने हाल ही में सरकारी और निजी क्षेत्रों में यह नीति लागू की है, और कई निजी कंपनियाँ भी इसे अपनी इच्छा से देती हैं। कोर्ट ने केंद्र सरकार और संबंधित अधिकारियों से कहा कि वे याचिकाकर्ता की प्रस्तुति पर विचार करें और सभी स्टेकहोल्डर्स की राय लेकर मासिक छुट्टी की नीति तैयार करने पर काम करें।
यह मामला शैलेन्द्र मणि त्रिपाठी द्वारा दायर तीसरी PIL थी। कोर्ट ने कहा कि अब याचिकाकर्ता को बार-बार अदालत में जाने की जरूरत नहीं है।
