US Tariff Row: ट्रंप के नए टैरिफ के खिलाफ 25 अमेरिकी राज्यों ने कोर्ट का रुख किया, भारत भी प्रभावित
US Tariff News: अमेरिकी राष्ट्रपति डोनाल्ड ट्रंप की नई टैरिफ नीति एक बार फिर कानूनी विवादों में घिर गई है। अमेरिका के 25 डेमोक्रेटिक नेतृत्व वाले राज्यों ने ट्रंप प्रशासन के Section 301 Tariffs को चुनौती देते हुए US Court of International Trade में मुकदमा दायर किया है। इन टैरिफ का असर भारत समेत 60 देशों पर पड़ रहा है।
राज्यों का आरोप है कि ट्रंप प्रशासन ने जबरन श्रम (Forced Labour) के नाम पर लगाए गए इन शुल्कों को कानून के अनुरूप लागू नहीं किया और इससे अमेरिकी उपभोक्ताओं व कारोबारियों पर अतिरिक्त आर्थिक बोझ पड़ेगा।
क्या है पूरा मामला?
पिछले महीने अमेरिका ने भारत सहित 60 देशों पर 10% से 12.5% तक अतिरिक्त टैरिफ लगाने की घोषणा की थी। ट्रंप प्रशासन का दावा था कि यह कदम उन देशों पर दबाव बनाने के लिए उठाया गया है, जो जबरन श्रम से बने उत्पादों के आयात को प्रभावी ढंग से नियंत्रित नहीं कर रहे हैं।
हालांकि, भारत ने अपनी विदेश व्यापार नीति में संशोधन करते हुए 14 जून को जबरन श्रम से बने उत्पादों के आयात पर रोक लगा दी थी। इसके बाद भारत के लिए प्रस्तावित 12.5% शुल्क घटाकर 10% कर दिया गया।
25 राज्यों ने कोर्ट में क्यों दी चुनौती?
न्यूयॉर्क की अटॉर्नी जनरल लेटिशिया जेम्स, गवर्नर कैथी होचुल और अन्य राज्यों ने अदालत से मांग की है कि इन टैरिफ को अवैध घोषित किया जाए।
लेटिशिया जेम्स ने कहा कि राष्ट्रपति के पास अपनी इच्छा से इतने व्यापक स्तर पर टैरिफ लगाने का अधिकार नहीं है। उनका कहना है कि टैरिफ दरअसल एक तरह का टैक्स है और इसका बोझ आम अमेरिकी नागरिकों और कारोबारियों पर पड़ता है।
कैलिफोर्निया के अटॉर्नी जनरल रॉब बॉन्टा ने भी कहा कि यह आर्थिक नीति अमेरिकी परिवारों और व्यापार जगत के लिए नुकसानदायक साबित होगी।
मुकदमे में क्या कहा गया?
याचिका में आरोप लगाया गया है कि ट्रंप प्रशासन ने Trade Act 1974 के तहत निर्धारित प्रक्रिया का पालन नहीं किया। साथ ही यह भी कहा गया कि Office of the United States Trade Representative (USTR) ने विभिन्न देशों और विशेषज्ञों द्वारा दी गई आपत्तियों पर पर्याप्त विचार नहीं किया।
याचिका के अनुसार, प्रशासन ने जबरन श्रम के नाम पर व्यापक टैरिफ लगाए, जबकि जांच रिपोर्ट में केवल कुछ सीमित उत्पादों का ही उल्लेख किया गया था। ऐसे में सभी देशों पर एक समान शुल्क लगाना उचित नहीं माना जा सकता।
भारत पर क्या असर पड़ेगा?
फिलहाल भारत पर 10% Section 301 Tariff लागू है, जबकि एक अन्य जांच अभी भी जारी है, जिसके आधार पर भविष्य में अतिरिक्त शुल्क लगाने का फैसला लिया जा सकता है।
विशेषज्ञों का मानना है कि यदि अदालत ट्रंप प्रशासन के खिलाफ फैसला देती है तो भारत सहित कई देशों को राहत मिल सकती है। वहीं यदि सरकार का पक्ष मजबूत रहता है, तो वैश्विक व्यापार पर इसका असर जारी रह सकता है।
