अमेरिका के होमलैंड सिक्योरिटी विभाग (DHS) ने एक बड़ा और कड़ा कदम उठाने का प्रस्ताव रखा है। इसके तहत नौकरी जाने के बाद विदेशी कामगारों को मिलने वाली 60 दिन की ग्रेस पीरियड (छूट की अवधि) को खत्म किया जा सकता है। इस बदलाव का सीधा असर अमेरिका में काम कर रहे हजारों भारतीय प्रोफेशनल्स पर पड़ सकता है।

किन वीजा धारकों पर पड़ेगा असर?

यह प्रस्ताव कई एंप्लॉयमेंट-बेस्ड नॉन-इप्रिग्रेंट वीजा श्रेणियों को कवर करता है। इसमें मुख्य रूप से H-1B वीजा धारक, L-1 इंट्रा-कंपनी ट्रांसफर वीजा और O-1 (असाधारण क्षमता वाले व्यक्तियों के लिए) वीजा धारक शामिल हैं, जो इससे सबसे ज्यादा प्रभावित होंगे।

वर्तमान नियम और नया तर्क

मौजूदा नियमों के तहत, नौकरी छूटने पर कर्मचारियों को नया जॉब खोजने, स्टेटस बदलने या अमेरिका छोड़ने की व्यवस्था करने के लिए 60 दिन या उनके अधिकृत प्रवास के अंत तक (जो भी पहले हो) का समय मिलता है।

लेकिन DHS का नया तर्क है कि यह ग्रेस पीरियड इन वीजा श्रेणियों के उस मूल उद्देश्य को कमजोर करता है जो सीधे तौर पर नौकरी से जुड़े हैं। विभाग का मानना है कि रोजगार खत्म होने के बाद भी वैध स्थिति में बने रहना नियमों के खिलाफ है। हालांकि, DHS ने यह भी स्वीकार किया है कि इस नियम से लोगों के व्यक्तिगत और आर्थिक जीवन पर गहरा असर पड़ सकता है।

भारतीय समुदाय पर सबसे बड़ा संकट

इस संभावित बदलाव से भारतीय प्रवासियों (Indian Diaspora) को सबसे बड़ा झटका लग सकता है, क्योंकि H-1B वीजा धारकों में भारतीयों की संख्या सबसे अधिक है।

USCIS के आंकड़ों के मुताबिक, 30 सितंबर 2025 को समाप्त हुए वित्त वर्ष में शुरुआती रोजगार के लिए स्वीकृत 1,14,806 H-1B याचिकाओं में से 57,747 (यानी 50.3 प्रतिशत) सिर्फ भारत में जन्मे लाभार्थियों की थीं।

अभी नियम लागू नहीं, जनता से मांगे गए सुझाव

यह प्रस्ताव अभी शुरुआती चरण में है और इसे पब्लिक कमेंट (जनता की प्रतिक्रिया) के लिए खोल दिया गया है। फीडबैक की समीक्षा करने और अंतिम नियम जारी करने में कई महीने लग सकते हैं। इसलिए फिलहाल यह नया प्रस्ताव तुरंत प्रभाव से लागू नहीं हुआ है।
